摘 要：快播公司涉嫌传播淫秽物品牟利案先后两次进行了公开审理，公诉人和辩护律师就电子数据检验鉴定相关问题展开了精彩的法庭辩论。辩论的焦点集中在电子数据检验鉴定资质、鉴定程序以及鉴定意见与案件相关性等问题上，本文围绕两次庭审中质证的焦点进行探析，并根据焦点问题提出建议，期望对司法实践工作有所借鉴。

Probe into the Examination and Identification of Electronic Data from
the Perspective of Court Survey
——Take “QVOD Case” as an Example

Abstract：The QVOD Technology Company was suspected of spreading obscene articles for profit，the case was publicly heard twice. The prosecutor and the defense lawyer launched a wonderful court debate on the issues related to the identification of electronic data. The debate focused on issues such as electronic data inspection and accreditation，identification procedures，and the relevance of identification opinions to cases. This paper analyzes the focus of cross-examination in two trials，and make suggestions on related issues to help judicial practice.
